
Terms and Conditions.
EVA Kitchens is a division of Et Voila Joinery LTD (NZBN : 9429050462568). All transactions, contracts, warranties, and obligations are legally carried out under Et Voila Joinery LTD. Any references to "EVA Kitchens" or “The Company” within these Terms and Conditions refer to the business operating as a division of Et Voila Joinery LTD. Clients acknowledge that EVA Kitchens is not a standalone entity and that all legal agreements are entered into with Et Voila Joinery LTD. These Terms & Conditions are relevant to Residential kitchen clients.
Consultations, Quotes, and Pricing Validity
Initial consultations and quotes are provided free of charge if the client proceeds with the project and pays the required deposit. If the client does not proceed, a fee of $250 plus GST applies for the consultation and quote service.
All quotes are valid for 21 days from the date of issue. After this period, EVA Kitchens reserves the right to revise the quote based on updated material and manufacturing costs.
If more than six (6) months pass between the date of the accepted quote and the start of manufacturing, EVA Kitchens reserves the right to adjust the contract price to reflect any increases in material or supplier costs.
Pricing Conditions and Additional Costs
The per linear metre pricing stated in the "Price and Process" section (starting from $850 plus GST) applies only to the specified materials and does not include a benchtop. Any modifications to the stated materials, including but not limited to handles, drawer or door fronts, hardware, sinks, or bins, will result in additional charges. Any changes made after a quote has been accepted will also incur additional charge-up costs.
Site Measurements
All site measurements must be conducted by EVA Kitchens. Measurements taken by any third party will not be accepted, and EVA Kitchens will not be held responsible for any discrepancies arising from external measurements.
Pricing and Currency
All prices stated by EVA Kitchens are in New Zealand Dollars (NZD) and are exclusive of GST unless otherwise specified.
Deposits and Payment Terms
A deposit of 50% of the total quoted price is required at least six (6) weeks before the scheduled installation begins. If the deposit is not received within this timeframe, the installation date may be rescheduled, and EVA Kitchens is not responsible for any delays caused by this. The remaining balance of the invoice must be paid in full within two (2) weeks after the date of completion. Payment may be made by direct banking or bank deposit.
Without prejudice to any other rights of action EVA Kitchens may have for late payment by the customer, the Company may charge interest on a daily basis to the customer at 12% per annum, until the overdue amounts are paid. The customer will also be liable to pay the total amount of expenses incurred by the Company (including legal costs) in attempting to obtain a remedy for the customers failure to comply with these terms. Failure by the customer to pay any debt due will entitle EVA Kitchens to cancel any contracts which the Company has with the customer.
Benchtop Supply and Installation
EVA Kitchens can supply and install laminate or stone benchtops at an additional cost per linear metre. Stone benchtops will be installed by a trusted third-party specialist, and EVA Kitchens remains responsible for their supply and installation. Quotes for benchtops are given additionally upon request.
Project Management
EVA Kitchens is responsible for all aspects of the kitchen project, including site measurements, manufacturing, assembly, delivery, and installation.
Appliances
EVA Kitchens does not sell or install appliances. Clients are responsible for sourcing and providing all appliances for their kitchen installation. If a client does not provide the correct specifications for their appliances before manufacturing begins, EVA Kitchens is not responsible for any cost changes required to modify the kitchen to accommodate them.
Cancellation and Refund Policy
Once the deposit has been paid, manufacturing begins. No refunds will be issued from this point onwards. Clients must ensure all specifications and details are correct before making the deposit payment.
Warranty
EVA Kitchens guarantees that all kitchen materials supplied by us will be free of defects in materials and workmanship for ten (10) years from the date of installation. This warranty covers material malfunction but does not extend to:
Normal kitchen wear and tear.
Product abuse resulting in damage.
Damage to appliances.
This warranty applies only to materials supplied and installed by EVA Kitchens and does not cover damage caused by improper use, improper cleaning products, water damage, or any modifications made by third parties after installation.
Liability Disclaimer
EVA Kitchens, as a division of Et Voila Joinery LTD, is not liable for any indirect, incidental, or consequential damages resulting from delays, defective materials supplied by third parties, or installation issues beyond our control. The total liability of EVA Kitchens (Et Voila Joinery LTD) shall not exceed the total contract value agreed upon with the client.
Timeline and Installation Delays
All estimated manufacturing and installation timelines are subject to change due to unforeseen circumstances, such as material supply delays or scheduling changes. EVA Kitchens will not be liable for any delays caused by factors beyond our reasonable control.
Any delay in the delivery of goods will not entitle the customer to cancel the contract or to refuse to accept delivery, or refuse to make payment. In no circumstances is EVA Kitchens liable for failure to deliver on time.
Ownership of Goods
All materials and components remain the property of EVA Kitchens (Et Voila Joinery LTD) until full payment has been received. EVA Kitchens reserves the right to withhold delivery or installation if the full balance has not been paid as per the agreed terms.
Dispute Resolution
In the event of a dispute, EVA Kitchens (Et Voila Joinery LTD) will seek to resolve the matter through mediation before legal action is pursued. Clients agree to engage in good faith discussions to resolve any concerns before initiating formal proceedings.
Governing Law
These Terms and Conditions are governed by and interpreted in accordance with the laws of New Zealand. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
